JUDGMENT

(Order of the Court was made by J.NISHA BANU, J.) This Writ Appeal is preferred by the appellant/Management against the order of dismissal of writ petition filed by the appellant/Management, confirming the award dated 03.01.2011 passed by the Labour Court in I.D.No.35 of 2009.

2. Today, when the matter is taken up for hearing, the learned counsel appearing for the appellant/Management as well as the 2nd respondent/employee would submit that the matter has been settled among the parties out of court and to that effect, a Settlement Deed, dated 20.07.2024 entered between the parties under section 18(1) of the Industrial Disputes Act has also been filed before this Court. The above Settlement Deed has been singed by both parties and duly attested by a Notary Public.

3. As per the above Settlement, the 2nd respondent/employee shall not claim any employment or benefits thereupon, whatsoever from the appellant/management and having regard to the same, he shall not file any case before any Forum.

4. Further, an acknowledgment receipt for payment of settlement amount has also been filed along with the Settlement Deed dated 20.07.2024, wherein, the 2nd respondent is acknowledging the receipt of Rs.10,05,000/- from the appellant / Management by way of Demand Drafts dated 20.07.2024 towards full and final settlement in the presence of witnesses.

5. The Settlement Deed, dated 20.07.2024 entered under section 18(1) of the Industrial Disputes Act duly singed by both parties and the acknowledgment receipt for payment of settlement amount are hereby recorded.

6. In view of the above, this Writ Appeal is disposed of in terms of Settlement Deed dated 20.07.2024. The original Settlement Deed dated 20.07.2024 shall form part of the records. No costs. Consequently, the connected miscellaneous petition is closed.
