Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, calling for the records of the second respondent in Na.Ka.No.142/2020/A2 dated 14.02.2020 and quash the same as non-est in the eye of law within a time frame.

This writ petition is filed against the proceedings of the second respondent dated 14.02.2020, which is nothing but a notice, calling upon the petitioner to attend an enquiry on 25.02.2020, with regard to the legal heirship certificate already issued in favour of the petitioner.

2. Heard the learned counsel for the petitioner.

3. I do not think that the present writ petition is maintainable as against the notice of enquiry. It is admitted by the learned counsel for the petitioner that the petitioner https://hcservices.ecourts.gov.in/hcservices/

has already participated in the enquiry conducted by the second respondent. Needless to say that it is for the second respondent to pass orders on merits and in accordance with law and therefore, the petitioner is not justified in approaching this Court and challenging the very notice of enquiry.

4. Thus, this Writ Petition is dismissed as not maintainable, without expressing any view on the merits of the claim made by the petitioner. The second respondent shall pass orders on merits and in accordance with law, if the enquiry conducted already is over, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
