The application has been filed to condone the delay of 2189 days in filing the written statement filed by the defendants 2 to 4 & 6 to 8 in the above suit.

2. The learned counsel for the applicants submitted that the delay was due to the death of D1 and the time taken to implead the legal heirs of the deceased first defendant.

3. The suit filed in the year 2016 for the relief of partition is still pending at the stage of filing written statement without further progress. Even though there is huge delay in filing the written statement, in the interest of justice, to enable further proceedings in the suit, this application is allowed.
