ORDER
The petition has been filed seeking police protection to the life of the petitioner and his property situated at Old No.70 New No.18, Gandhi Road, Vellore based on the complaint given by the petitioner and his brother dated 14.05.2024.
2. It is seen that the property situated at Old No.70 New No.18, Gandhi Road, Vellore has been rented out to the respondents 3 and 4 herein. The petitioner has filed RCOP No.14 of 2011 before the District Munsif Court, Vellore for evicting the respondents 4 & 5 and the same was ordered in favour of the petitioner and after obtaining eviction order, the respondents 4 and 5 filed an appeal and the same was dismissed by confirming the order of the Trial Court. However, the respondents 3 and 4 occupied the said property, doing business in the premises. The petitioner can very well file an appropriate petition before the Rent
Controller instead of filing a petition before this Court for police protection against the persons who are enjoying the property. Therefore, this petition cannot be maintained.
3. Accordingly, this Writ Petition is dismissed. The petitioner is at liberty to approach the Civil Court for appropriate relief. No costs. 25.02.2025 Index : Yes/No : Yes/No Speaking/non-speaking order rkp To 1.Superintendent of Police, Vellore District, Vellore.
2.The Inspector of Police, Vellore North Police Station, Vellore.
