O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(2) and Section 318(4) of BNS, 2023 and Section 34(2) of National Medical Commission Act, 201942 in Crime No.42 of 2026, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioner is that the petitioner would basic qualification running clinic which resulted in causing injury to one of the victim and hence based on the complaint, the Medical Officer attached to the Government Hospital has lodged a complaint to the Police. Based on the complaint, the respondent police went to the occurrence and seized the medicines kept in the clinic and the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is not running the clinic as alleged in the FIR and he has been falsely implicated in this case and he only LIC agent. He further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the District Chief Medical Officer has conducted inspection and found that the petitioner was involved in illegal running of clinic and the complaint has been lodged. He further submitted that, in this case, investigation in this case is pending. Hence, he opposed for grant of anticipatory bail to the petitioner.

Considering the nature of allegation that the petitioner without requisite qualification was running a allopathy clinic and the case is connected with public health and if the petitioner is granted anticipatory bail, there is likelihood that petitioner shall indulge in similar offence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 17.02.2026 sma 3/4
