Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the 1st respondent to issue No Objection Certificate to the petitioner for Plot No. 37 in Survey No. 632/1, Sholinganallur Village, Tambaram Taluk, Kancheepuram District.

By consent, the main writ petition itself is taken up for final disposal.

The petitioner claims that he is the owner of the vacant house site property, admeasuring an extent of 2190 sq.ft. described as Plot No.37, in the approved layout MMDA PPD/LO.No. 220/1989 comprised in Survey No. 632/1, situated at Old No. 155, New No. 138, Sholinganallur Village, Thambaram Taluk, Kancheepuram District and claims to have purchased the same, by means of a sale deed registered as Document No. 2924 of 2000 dated 07.11.2011 on the file of SRO, Neelangarai. The petitioner wants to construct a house in the said property and submitted a representation dated 04.04.2015 the respondent seeking No Objection Certificate. Since he was not favoured with any response, he has come forward to file the present writ petition.

This Court heard the submissions of Mr.V. Anandamoorthy, learned counsel, who accepts notice on behalf of the respondent. 4.

Though the petitioner has prayed for a larger relief, in the facts and circumstances, this Court deems it fit to direct the respondent to consider the representation of the petitioner dated 04.04.2015 and pass orders on the same, on merits and in accordance with law, as expeditiously as possible, in any event, not later than 8 weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner. The writ petition is disposed of accordingly. No costs.
