ORDER
The writ petition has been filed seeking a mandamus to the first respondent to dispose of the appeal dated 24.05.2025, within the time fixed by this Court.
2. The case of the petitioner is that her father named P.K.Marimuthu owned certain ancestral properties. He died on 23.12.1999 leaving behind his wife M.Bakiyam and 5 children namely the petitioner herein, Jagathambal, Shanthi @ Danam, M.Semanathan and M.Kandhasamy, the third respondent herein. One of her sibling named M.Karthikeyan had predeceased her father P.K.Marimuthu. The grievance of the petitioner is that the third respondent had obtained a legal heir certificate excluding the name of deceased M.Karthikeyan with an intention to grab the family property and enrich himself. The petitioner would also submit that as against the partition of family properties, a suit is pending before the III Additional Court at Coimbatore. While so, the third respondent is engaged in illegal transaction of acquiring the ancestral properties.
3. Alleging the fraudulent act of the third respondent, the petitioner had submitted a representation before the first respondent on 24.05.2025 and the same is still pending. The petitioner had also submitted a reminder to the
respondents on 25.12.2025 to consider her representation. But the same is in vain. Hence, the petitioner is before this Court.
4. Considering the facts and circumstances of the case, a mandamus is issued to the first respondent to consider the representation of the petitioner dated 24.05.2025 after issuing notice to the petitioner and other interested parties concerned and also after affording them an opportunity of hearing, and dispose of the same within a period of one month from the date of receipt of a copy of this order.
