ORDER
The present Writ Petition has been filed seeking a direction to the Respondents to allow the Petitioner to operate under valid Drug License Nos. TN/Z05/20B/00623 and TN/Z05/21B/00623 as no order of suspension or cancellation has been served till date by removing the seal to restore the business activities of M/s Sencure Pharmaceuticals.
2. Mr.K.Tippu Sulthan, learned Government Advocate takes notice on behalf of the respondents.
3. The petitioner is the dealer in pharmaceutical drugs. On 29.09.2025, the petitioner's business premises was sealed and he was arrested in connection with crime no.1077/2025 for the alleged offences under Sections 8(c) r/w 22 (b) of the NDPS Act, 1985, Sections 18(c) and 27A(1) of the Drugs & Cosmetics Act, 1940 and Sections 238, 276 and 277. Subsequently he was released on conditional bail by this Court in Crl.R.C.No.2860 of 2025. Thereafter, the petitioner submitted a formal representation dated 30.12.2025 to the respondents requesting them to de-seal the premises. However, the said representation has not been considered till date. Hence, the present Writ Petition.
4. Learned counsel appearing for the petitioner submitted that, it would suffice, if this Court issues a direction to the respondents to consider the petitioner's representation dated 30.12.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.
5. On the above contention, this Court heard the learned Standing Counsel appearing for the respondents.
6. In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 30.10.2025 and pass appropriate orders on the same in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.
7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
