W.M.P.No.6658 of 2023 in W.P.No.34509 of 2022 W.M.P.No.6658 of 2023 in W.P.No.34509 of 2022 M.S.Ramesh.J., The prayer sought for in WMP.No.6658 of 2023, is for grant of interim injunction restraining the respondent from putting up any compound wall or fencing the property in respect of lands to the extent of 0.92 cents in Survey No.140/3 of Kizhkuppam Village No.86 of Arakkonam Taluk, Vellore District.
2. In the impugned order, which is under challenged in the main Writ Petition, it is stated that the subject lands are Government Kallanguthu Poramboke lands and that the petitioner herein, is not in possession of the same.
3. Per contra, in the grounds raised by the petitioner, it is stated that he is in possession of the lands for several years and that this Court had also in its earlier order had taken note of the fact and directed the respondents to consider the representation.
4. The learned Additional Government Pleader, on instructions submitted that the respondents have already put up a fencing on all the four sides of the subject lands in Survey No.140/3 of Kizhkuppam Village No.86 of Arakkonam Taluk, Vellore District. 5. The issue, as to whether the second respondent can be directed to issue patta to the petitioner herein, will be decided at a later stage. However, in view of the fact that the prayer sought for in the interim application has become infructuous, the miscellaneous petition stands closed.
