HIGH COURT LEGAL SERVICES COMMITTEE, CHENNAI Lok Adalat - I organised by the High Court Legal Services Committee Monday the 28th day of February 2022 LOK ADALAT AWARD (Chapter VI and u/s 21 of Legal Services Authorities Act, 1987) Presided over by The Hon'ble Mr.JUSTICE R.KARUPPIAH(Retd) and Member Mrs.M.Rajalakshmi, District Judge (Retd) C.S.No.218 of 2015 Prayer: This Civil Suit has been filed praying for (a) directing the defendant to pay a sum of Rs.81,00,000/- (Rupees Eighty one lakhs only) together with interest at the rate of 24% per annum on Rs.50,00,000/- from the date of plaint till realization, due under the Preliminary Decree and in default permit the plaintiff to apply for final decree for sale of the Mortgaged property for realization of the amount determined by this Hon'ble Court;

(b) In case the proceeds of the sale as ordered by this Hon'ble Court is found to be insufficient to pay the amount due to plaintiff, then that liberty be reserved to the plaintiff to apply for personal decree for the balance amount;

(c) for the cost of the suit;

N.D.Ram Manohar .. Defendant This case came up for settlement before the Lok Adalat today. Plaintiff and Mr.S.Rajendran, counsel for the plaintiff and Defendant and Mr.G.Sugadev Raja Guru, learned counsel for the defendant are present.

TERMS OF SETTLEMENT Both parties have filed a Joint Compromise Memo duly signed by both parties and the same is recorded. The aforesaid Joint Compromise Memo shall form part of the award.

2. In view of the above said Joint Memo of Compromise, the suit is dismissed.

3. The full Court fee shall be refunded to the plaintiff in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994 and there shall be no demand for additional Court fee.
