ILANTHIRAIYAN CRIMINAL MISCELLANEOUS PETITION No.2926 of 2019 in CRL OP.No.29081 of 2018 R.VEERAKUMAR [ PETITIONER ] Vs THE STATE REP BY ITS, [ RESPONDENT ] THE INSPECTOR OF POLICE, KEELAIYUR POLICE STATION, NAGAPATTINAM DISTRICT CRIME NO.330 OF 2018.

Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition order in Crl.O.P.No.29081 of 2018 order dated 10.01.2019 Para No.5 (d) the petitioner shall report before the respondent police daily at 10.30 a.m for the period of two weeks and thereafter as and when required for interrogation modified that the petitioner shall appear before the respondent every sunday.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.P.MUTHAMIZH SELVAKUMAR, Advocate for the petitioner, and of M/S M.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent, the court made the following order:- This petition has been filed seeking to modify the condition imposed by this Court in Crl.O.P.No.29081 of 2018 for the offence punishable under Sections 147, 148, 341, 324, 307, 294(b) of IPC and Section 3(1) Tamil Nadu Public Property (Prevention of Damages & Loss) Act, 1992 in Crime No.330 of 2018, while granting anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. 3.The learned counsel for the petitioner would submit that the petitioner is an engineering student and he is going class regularly

at 9.00 a.m to 3.30 p.m., hence, he could not complied with the condition imposed by this Court. Therefore, he prays for modification.

4. The learned Additional Public Prosecutor would submit that the condition imposed by this Court is that the petitioner shall report before the respondent police daily at 10.30 a.m. for the period of two weeks and thereafter as and when required for interrogation. He would further submit that the petitioner has not complied with the condition even a single day. Hence, he vehemently opposed for grant of modification.

5.Taking into consideration the nature of the allegation and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to modify the condition imposed on the petitioner.

6.Accordingly, this Criminal Miscellaneous Petition stands dismissed.
