Though the learned counsel for the appellants has taken out these civil miscellaneous petitions to condone the delay of 572 days in filing the petition to set aside the abatement caused by the death of the 1st respondent and to bring on record the respondents 4 to 8 as the legal heirs of the first respondent, it is reported by Mr.N.Kamaraj, the learned counsel for the respondents that there are other legal heirs who have been left out. He also furnished a copy of the legal heir certificate to the learned counsel for the appellants.

In view of the same, the learned counsel for the appellants seeks permission to not press the above 3 civil miscellaneous petitions, with liberty to take out fresh application to bring all the legal heirs on record. Permission is granted. 3.

The above civil miscellaneous petitions are dismissed as not pressed with liberty to file a fresh application impleading all the legal heirs of the deceased 1st respondent.
