O R D E R

The instant Civil Revision Petition has been filed against the order dated 29.10.2012 passed in I.A.No.695 of 2010 in O.S.No.115 of 2010 by the Hon'ble Subordinate Judge of the Nilgiris at Udhagamandalam, seeking to set aside the same.

2. When the matter is taken up for hearing today, the learned counsel appearing for the respondents submitted that the suit itself has been dismissed for default as early as on 10.08.2016. Hence, the present Revision Petition has become infructuous.

3. Recording the above submissions, this Civil Revision Petition is dismissed as infructuous. In the event of restoring the suit, the revision petitioner is at liberty to file an application to restore this

petition. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
