Petition filed under Article 226 of the Constitution of India for issuing a writ of mandamus directing the transfer of Crime No.21 of 2012 on the file of the District Crime Branch, Villupuram to the Central Bureau of Investigation or to any other independent agency; to direct the District Collector, Villupuram/1st respondent from revoking the suspension made in A6/2677/2012-1 dated 07.09.2012 issued against Thiru.K.Elumalai;
to place M.Venkatesan, the then Block Development Office (Scheme) presently working as Block Development Officer, Vanur Taluk, Villupuram District under suspension and to take appropriate departmental action besides initiating criminal prosecution against him; to restrain the 1st respondent from taking any further action against the petitioner pursuant to the proceeding Dt.28.05.2013 made in A6/2677/2012 till the disposal of the Crime No.21/2012 and Crime No.9/13 on the file of the District Crime Branch Villupuram.

Consistently, there is no representation for the petitioner. When the matter was listed for hearing on 27.07.2020, there was no representation for the petitioner, hence, the Writ Petition was adjourned to 07.08.2020. On 07.08.2020 also, the learned counsel for the petitioner was not present to make his submission, hence, the matter was adjourned to 03.09.2020. On 03.09.2020 also, the learned counsel for the petitioner was not present and hence, the Registry was directed to list the matter under the caption "for dismissal" on 07.09.2020 (i.e.) today. Though the matter has been listed under the caption "for dismissal", today also, the learned counsel for the petitioner is not present and hence, this Court has no other option, except to dismiss the Writ Petition for non-prosecution. Accordingly, the Writ Petition is dismissed for non-prosecution. No costs. Consequently, the connected miscellaneous petitions are closed.
