This application has been filed by the applicant seeking grant of leave to sue the defendant/respondent Nos.1 to 3, 5 to 14, 16 to 30, 32, 34 to 36.
2. The suit is filed for permanent injunction, inter alia, alleging the infringement of copyright.
3. The learned counsel appearing for the applicant thus submits that the said copyright is pursuant to the Movie. The respondents are infringing the right of the applicant by pirating the Movie without authorisation. Some of the respondents are residing outside the territorial jurisdiction of this Court, though the cause of action has arisen within the territorial jurisdiction of this Court.
4. As it is submitted that infringement has taken place within the territorial jurisdiction of this Court, leave will have to be granted. Considering the submissions made by the learned counsel for the applicant and taking note of the averments made in the plaint, leave is granted. 05.08.2016 ogy
