J U D G M E N T

(Judgment of the Court was delivered by R.SUBRAMANIAN, J.) Challenge is to the order of the writ Court dated 08.01.2025 made in W.P.No.10199 of 2022.

2. The prayer in the Writ Petition was in respect of the correctness of the final key answers for 8 questions in part A and 2 questions in part B. It is the case of the petitioner that these final key answers are incorrect and he has also produced certain documentary evidence to show that the final key answerers are incorrect.

3. If the petitioner's contention is accepted, the petitioner would get 14 marks in addition to whatever he has already been awarded. Though the petitioner has been provisionally selected, if the contentions of the 2/6

petitioner in the Writ Petition are accepted, then his seniority would go up in the order.

4. The learned Single Judge had concluded that the petition has become infructuous since the selection process is completed. We are unable to sustain the order of the learned Single Judge. If this Court finds that the contentions of the petitioner are correct and the final key answers are incorrect, several other candidates who had also answered these questions would also get the benefit. As already pointed out there is a possibility of the petitioner's seniority getting revised. Hence, the Writ Petition ought not to have been dismissed as having become infructuous.

5. We therefore, set aside the order and remit the matter to the learned Single Judge to be decided on merits. It is stated that an amendment application has also been filed by the petitioner and the same has been closed. That petition will also stand restored.

6. TheWrit Appeal stands allowed as indicated above. No costs. 3/6
