C.M.P.No.5031 of 2020 in A.S.No.316 of 2017 and A.S.No.317 of 2017 R.SUBBIAH, J and R.HEMALATHA, J (The Order of the Court was made by R.Subbiah, J) This Civil Miscellaneous Petition (C.M.P) is filed to modify paragraph 7(ii) of the decree, dated 04.10.2019 in A.S.Nos.316 and 317 of 2017 as detailed in the affidavit filed in support of the CMP.

2. Earlier, when the Appeal Suits in A.S.Nos.316 and 317 of 2017 came up before this Court on 10.02.2020 under the caption "for being mentioned", in Clause 7(ii) of the decree, the Plot Numbers were modified as G5 and G6, but the contents were not incorporated and as the decree could not be drafted, the present C.M.P. is filed to modify the decree in Clause 7(ii) as detailed in the affidavit filed in support of the C.M.P.

3. Upon hearing the learned counsel appearing for the parties and upon perusing the judgment and decree dated 04.10.2019 and the modified decree dated 10.02.2020, this Court is of the view that the Clause 7(ii) of the said decree shall be amended as prayed for in this C.M.P. Page No.1/4

4. Further, the Registry is directed to mark a copy of the judgment and decree dated 04.10.2019 and the earlier modified decree dated 10.02.2020 and the amended decree ordered today (13.03.2020) to the Sub-Registrar of Neelangari, Chennai so as to record the same in the Index Register of the Sub-Registrar Office.

5. In other respects, the earlier judgment and decree dated 04.10.2019 (final judgment and decree) and modified decree dated 10.02.2020 shall remain unaltered.

6. With the above observations, C.M.P. is ordered as prayed for. The Registry is directed to modify the decree after verification and as detailed now in the affidavit filed in support of the C.M.P. (R.P.S.J) (R.H.J) 13.03.2020 cs Registry is directed to issue fresh decree copy to the parties after making the corrections as stated in this CMP and also send a copy of this order to the Sub-Registrar, Neelangari, Chennai, along with the copy of the amended decrees and judgment copy for recording the same in the Index Register of the Sub-Registrar Office.
