The petitioner has filed this writ petition to call for the records pertaining to the order of the first respondent in Rc.No.ESTT III (1) / 850/83326/2011 CPO No.16/12 dated 03.01.2012 upgrading Head Constables Special Sub Inspector of Police (Local) and quash the same in so far as the non inclusion of the petitioner in upgradation list is concerned and consequently, direct the respondents 1 and 2 to promote the petitioner as Special Sub Inspector of Police (Local) with effect from 01.10.2011 and place him the proper seniority.
2. Learned Additional Government Pleader appearing for the respondents 1 & 2 submitted that the petitioner has passed away in the year 2018 and to substantiate the same, he has submitted a copy of the death certificate dated 03.07.2018 issued by the Madurai Corporation. He has further submitted a copy of the order 15.11.2011 stating that the petitioner has been settled with all the benefits, which have been payable to him. Page No.3 of 6
3. In view of the above submission made by the learned Additional Government Pleader appearing for the respondents, nothing survives in this writ petition for further adjudication. Accordingly, this writ petition stands closed. No costs.
