Prayer in WMP.No.39547 of 2025: Writ Miscellaneous Petition filed to amend the prayer seeking to issue a Writ of Declaration declaring that when the 2 nd
respondent changed the tentative key answer to question No.106 in Botany from Pteridophytes to Marine algae in the final key answer the burden lies on the 2 nd respondent to prove that the final key answer namely Marine algae is the correct answer to question No.106 in Botany and the 2 nd respondent having failed to discharge the said burden to the satisfaction of this Court, the 2 nd respondent is under a legal obligation to award one mark to the petitioner for giving the answer to question No.106 as Pteridophytes taking the total marks secured by the petitioner to 79 in the written examination and consequently declare the petitioner as eligible to the post of PG Assistant in Botany pursuant to Notification No.10/2019, dated 12.06.2019 issued by the 2 nd respondent and direct the 2 nd respondent to select the petitioner for the post of PG Assistant in Botany, instead of the prayer made in the writ petition, as stated above. ORDER
Heard the learned counsel for the petitioner and learned Addl. Advocate General appearing on behalf of Standing Counsel for 2 nd respondent and learned Govt. Advocate appearing for the 1 st respondent.
2. The present writ petition has been filed by the petitioner assailing the action of the respondents and seeking a direction to the 2 nd respondent to furnish a copy of the Expert Committee Report to this Court in relation to the
objections raised by the 3 rd respondent who had applied for the post of PG Assistant, pursuant to the Notification issued by the 2 nd respondent in Notification No.10/2019, dated 12.06.2019, to enable the petitioner to know whether the objections raised by the 3 rd respondent to the key answer to question No.106 in the Botany subject has been accepted by the Expert Committee or not in terms of the legal notice dated 05.02.2020 issued on behalf of the 3 rd respondent.
3. Learned Addl. Advocate General appearing for the respondents submitted that on a similar challenge being made to the notification No.10/2019, dated 12.06.2019, more particularly, in relation to the same issue involved in the present writ petition, i.e., key answer to question No.106 in Botany, a Division Bench of this Court had held that "interference with the Expert Committee Report and the recruitment process at every stage, would only hamper the recruitment process leading to inordinate delay in selecting the candidates for appointment" and accordingly, dismissed the Writ Appeal filed by the petitioners therein.
4. Since, the Division Bench of this Court had held that the opinion of
the Expert Committee to be final, this Court is of the view that the petitioner who is also seeking similar relief, is not entitled to maintain the present writ petition. Though the petitioner had sought to amend the prayer from that of Writ of Mandamus to the one of Writ of Declaration, it is to be noted that by seeking the aforesaid amendment, the petitioner is changing the entire cause of action and nature of the writ petition, which cannot be permitted at this stage.
5. In view of the aforesaid discussion, the Writ Petition as well as Writ Miscellaneous Petition are dismissed.
