The petitioner, who apprehends arrest at the hands of the respondent Police for the alleged offences under Sections 379, 430 of IPC r/w 21(i) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.21 of 2022, on the file of the respondent police, seeks anticipatory bail. 2.

The petitioner herein is the owner of the lorry in which 3 units of Red sand was illicitly transported. On seeing the respondent, the driver of the lorry has abandoned the load and the lorry and fleded away. 3.

This anticipatory bail is filed claiming that the petitioner is an innocent person. However, the incriminating evidence indicates that the lorry is owned by the petitioner and the red sand was transported illicitly on his instructions.

Considering the gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 5.
