PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari, calling for the records pertaining to the order passed by the 2nd respondent in his proceedings in Na.Ka.No. 078056/C3/E1/2022 dated 23.01.2023 and quash the same. ORDER
With the consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner herein is aggrieved against the proceedings of the third respondent dated 24.11.2022, whereby the petitioner's post has been declared as surplus.
3. Today, when the matter was called, the learned Additional Government Pleader produced a copy of the proceedings of the first 2/5
respondent dated 10.02.2023, whereby it is stated that the respondents have, in principle, taken a decision not to deploy the surplus staff for the year 2022-2023. As such, the apprehension of the petitioner that she would be deployed to some other school may not arise.
4. The learned Special Government Pleader, particularly in this case, on instructions, submitted that the said proceedings dated 10.02.2023 will also equally apply to the Government Schools and that deployment will not be done during the middle of the academic year.
5. In view of the proceedings of the first respondent dated 10.02.2023, no effective orders can be passed in the present Writ Petition. Accordingly, the Writ Petition stands closed. No costs.
