ORDER

This Writ Petition has been filed seeking for a direction to the respondents to restore the land and cancel the patta for the property more fully

described in the prayer to this writ petition based on the petitioner's representation dated 06.01.2026.

2. At the outset, the learned counsel for the petitioner would submit that the petitioner is confining his relief only with regard to the cancellation of patta and is not pressing for restoration of the land. The said statement is recorded by this Court.

3. Since the petitioner's representation dated 06.01.2026 has not been considered till date, the petitioner has filed the present writ petition.

4. Mr. C. Jayaprakash, learned Government Advocate accepts notice on behalf of Respondents 1 to 4.

5. The competent authority to consider the petitioner's representation, seeking for cancellation of patta, is the third respondent. No prejudice will be caused to the respondents if the petitioner's representation seeking for cancellation of patta for the property morefully described in the writ petition, which is presently standing in the name of the 5th respondent, is considered on merits and in accordance with law after hearing the objections of the 5th respondent and any other third party, whom the third respondent deems fit to enquire, within a time frame to be fixed by this Court.

6. This Court is not expressing any opinion on the merits of the petitioner's representation.

7. Since no adverse orders are passed against the 5th respondent, notice to the 5th respondent is dispensed with.

8. For the foregoing reasons, this writ petition is disposed of by directing the third respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 06.01.2026, insofar as the cancellation of patta standing in the name of the 5th respondent alone, after hearing the objections of the 5th respondent and any other third party whom the third respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
