ORDER

This application has been filed by the applicant to reopen the defendants side evidence for examination of DW2 in C.S.No.231 of 2019.

2. According to the applicant, he is the fourth defendant in the main suit. Already DW1 was cross examined. When the matter is posted for examination of further witness, the fourth defendant was unable to produce the witness DW2. Now they are ready to examine DW2. Therefore, filed this application to reopen the case.

3. The other side have not seriously objected.

4. Considering the reasons stated in the affidavit and facts and circumstances of the case, in order to give a fair chance to the applicant, it is appropriate to allow this application. Accordingly, this application is allowed.

5. The matter is referred to the learned Master on 02.03.2026. The learned Master is directed to complete the evidence within a week after the appearance of DW2.
