Today, when the appeal came up for hearing, the learned counsel for the respondent alone appeared before this Court. In fact, on 13.12.2021, when the appeal was taken up for hearing, there is no representation for the appellant. In view of the same, this Court, directed the Registry to post the matter under the caption 'for dismissal on 17.12.2021'. Even today, there is no representation on behalf of the appellant either in-person or through learned counsel.

2. Hence in view of the above, the present Second Appeal is dismissed for default.

Consequently connected miscellaneous petition is closed. No costs.
