Order IV Rule I of Original Side Rules, to pass a judgment and decree against the defendant directing to pay the plaintiff:

(a) a sum of Rs.3,01,35,000/-- with interest at the rate of 18% p.a. from the date of plaint till the date of repayment or realisation (b) for costs of this suit PRAYER Civil Suit is filed under Order VII Rule I of CPC r/w. Order IV Rule I of Original Side Rules, to pass a judgment and decree : (i) Directing the defendant to pay a sum of Rs.3,43,69,570/- (Rupees Three Crore Forty Three Lakhs Sixty Nine Thousand Five Hundred and Seventy One) as on the date of the suit due by the defendant to plaintiff and further directing the defendant to pay the interest thereon for Rs.2,57,00,000/- at the rate of 6% per annum from the date of plaint till the date of realization (ii) direct the defendant to pay the costs of this suit.

Mr.D.Prathap COMMON JUDGMENT When the matter is taken up today, the learned counsel for the plaintiff in both suits represented that the matter has been amicably settled between the parties outside the Court and the suits shall be dismissed as withdrawn. They have also made endorsements to that effect in the court bundle.

2. Recording the submission of the learned counsel for the plaintiff in both suits, these suits are allowed to be withdrawn as settled out of Court. In view of the same, the Court fees is ordered to be refunded to the parties. No costs.
