These petitions are filed to condone the delay of 363 days in filing the application to set aside the abatement caused by the death of the third respondent in the Original Petition, to set aside the abatement caused due to the death of the third respondent and to bring on record the proposed respondent as the legal representative of the deceased third respondent and rank her as the fifth respondent in the Original Petition.

2.Heard the learned counsel for the applicant and the learned counsel for respondents 1 and 2 in all the applications. Learned counsel for respondents 1 and 2 has no objection for allowing the applications.

3.Considering the averments made in the affidavits filed in support of the applications, the delay is condoned, the abatement caused due to the death of the third respondent is set aside and the proposed respondent is ordered to be brought on record as fifth
