....Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of declaration declaring that the selection made by the 2nd respondent for appointment to the post of Village Health Assistant/Auxiliary Nurse Midwife based Notification No.17/MRB/2019 dated 24.10.19 as null and void in view of the exclusion of the candidates who were qualified as Nursing Assistant/Multipurpose Health Worker and further direct the respondents to select and appoint the petitioner as Village Health Assistant/Auxiliary Nurse Midwife.

O R D E R

This Writ Petition is filed to declare that the selection made by the 2nd respondent for appointment to the post of Village Health Assistant/Auxiliary Nurse Midwife based Notification No.17/MRB/2019 dated 24.10.19 as null and void in view of the exclusion of the candidates who were qualified as Nursing Assistant/Multipurpose Health Worker and further direct the respondents to select and appoint the petitioner as Village Health Assistant/Auxiliary Nurse Midwife.

2. The learned counsel for the petitioner would submit that subsequent to the notification dated 24.10.2019, recruitment process was over and 1,234 vacancies have already been filled. He further submit that since the selection list was already been published, nothing survives in the present writ petition.

3. Recording the submissions made by the learned counsel for the petitioner, this Writ Petition is dismissed. However, the petitioner is given liberty to challenge the merit list, if otherwise he is entitled to do so. No costs.
