The petitioner, who was arrested and remanded to judicial custody on 13.02.2023 for the offences punishable under Sections 505(1)(b) of IPC and Section 3(1) of the Public Properties Damages Act in Crime No.64 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner, to register his protest towards the drawings depicted in the bridge pillars by the Coimbatore Corporation, poured the black paint over it and thereby, caused loss to the tune of Rs.2,00,000/-. Hence the complaint. 3.Learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that since the paintings depicted in the pillars had portrayed certain people belong to a particular community in a bad light, some people have erased the above drawing by using black paint

and subsequently, the Corporation erased other paintings. He further submitted that the petitioner has nothing to do with the alleged offence and he is ready to abide by any stringent condition that may be imposed by this Court and he is in judicial custody from 13.02.2023 and hence, he prayed to grant bail to the petitioner.

4.Learned Government Advocate (Crl.Side) for the respondent submitted that the petitioner to register his protest towards the drawings depicted in the bridge pillars by the Coimbatore Corporation, poured black paint over it and thereby caused loss to the tune of Rs.2,00,000/-. He further submitted that there are two previous cases pending against the petitioner. Hence, he vehemently opposed to grant bail to the petitioner.

5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the materials available on record.

6.Considering the facts and circumstances of the case and the submissions made by both counsel and the previous bad antecedents of the petitioner and the nature of the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 01.03.2023 vkr
