ORDER : The Court Made the following order :- The petitioner apprehends arrest by the respondent police for the offences punishable under Sections 7(b) of the Prevention of Corruption (Amendment Act), 2018, in Crime No.01/AC/2022/CC-II, is before this Court seeking anticipatory bail.

From the First Information Report and the material placed by the learned Government Advocate (Crl. Side) before this Court, this Court finds that this petitioner through the surveyor i.e., A2 had demanded bribe of Rs.5,00,000/- from the defacto complainant and threatened the defacto complainant for consequential cancellation of patta issued in his favour on 12.01.2022.

The respondents had laid trap and recovered Mahazar currency note from the second accused in which, the name of the petitioner herein written on the cover. The statement of the co-accused viz., A2 clearly inculcates the present petitioner. The veracity of the statement has to be tested during the trial. Further more, the investigation is pending and the voice recorded at the time of demand made undue advantage has to be sent for forensic department, after drawing sample from the accused.

Since the investigation is in very nasal stage, this Court is of the view that for granting anticipatory bail to this petitioner will lead to distortion of evidence available and hamper the course of investigation. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
