PRAYER: Writ Petition filed under Article 226 of the Constitution of India to praying to issue a Writ of Certiorari, to call for the records relating to order in Na.Ka.No.2416/2025/Aa1 dated 17.11.2025 issued by the 3rd respondent and to quash the same.

O R D E R
(Order of the Court was made by C.KUMARAPPAN,J.,) The present Writ Petition has been filed assailing the memo issued by the Tahsildar dated 17.11.2025 addressing to the Revenue Inspector, wherein, the Tahsildar had directed the Revenue Inspector to proceed under Section 7 of the Tamil Nadu Land Encroachment Act, as there was a direction by this Court in W.P.No.12007 of 2023 dated 23.06.2025.

It is the contention of the learned counsel for the petitioners that the subject land in S.F.No.3 of an extent of 2.43 hectares in Thandalam Village is the absolute property of the petitioners and that the very memo issued by the Tahsildar is in contravention to the Tamil Nadu Land Encroachment Act. Hence, prayed to interfere with the same. 2/6

The said contention was stoutly objected by the learned Special Government Pleader and he would contend that the very impugned memo is only an inter-Department communication, which will not give any cause of action to the petitioners to prefer a Writ Petition. He would further submit that such memo was issued only based upon the orders of this Court and that so far no enforcement action has been commenced by the Revenue Authorities under the Act. Hence, prayed to dismiss the Writ Petition.
4. We have given our anxious consideration to the submissions of the learned counsel on either side.

While looking at the impugned memo, it is clear that it is an interDepartment communication addressed by the Tahsildar, Thiruporur to the Revenue Inspector, Thiruporur, and in this he has only stated that the Revenue Inspector has to take action in accordance with the Tamil Nadu Land Encroachment Act, as there is a direction by this Court in W.P.No.12007 of 2023. Therefore, as rightly submitted by the learned Special Government Pleader so far no enforcement actions have been taken in this matter and that the enforcement action will be taken only after conducting survey of the property.

6. Therefore, we do not find any reason to entertain the Writ Petition at this juncture. In the result, the present Writ Petition is dismissed as it is pre-mature. No costs. The connected miscellaneous petition in W.M.P.No.7013 of 2026 is ordered on payment of separate Court fee and the other connected miscellaneous petitions in W.M.P.Nos.7015 and 7017 of 2026 are closed.
