The petitioner, who was arrested and remanded to judicial custody on 03.01.2023, for the offences punishable under Sections 294(b), 323, 307, 506(ii) of IPC and alter under Section 8(c), 20(b)(ii)(B) of NDPS Act, in Crime No.2 of 2023, seeks bail. 2.The case of the prosecution is that based on the secret information the respondent police have found that the petitioner having possession of 1.250 kg of Ganja without any valid licence. Hence, the complaint.
3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against him. gbi pending against him. He would submit that the respondent seized the contraband. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5.Taking into account the fact that the petitioner is a habitual offender and has eight previous cases to his credit, this Court is not inclined to grant bail to the petitioner.
