ORDER
By this application, the plaintiff seeks permission to file the 1/4
documents mentioned in paragraph 14 of the affidavit in support of this application. In the affidavit in support of this application, it is stated that the defendant raised claims/defences in the written statement, which necessitated the filing of a reply statement and these additional documents. It is further stated by learned counsel for the plaintiff that the plaintiff was permitted to file a written statement by order dated 04.12.2024.
2. Learned counsel for the defendant opposes this application. He submits that the documents sought to be filed now are documents that were in the possession, control or custody of the plaintiff at the time of institution of the suit. He further submits that both parties agreed to proceed with the trial and that the interim injunction was made absolute on that basis.
3. Upon considering the reasons set out in the affidavit in support of this application and being satisfied that reasonable cause is shown, this application is allowed subject to the right of the defendant to file an affidavit of admission/denial in respect of additional documents and raise objections, inter alia, on the grounds of admissibility, relevance and proof 2/4
in course of trial.
