( Special Original Jurisdiction ) Monday, the Eighteenth day of September Two Thousand Seventeen PRESENT THE HON`BLE MR JUSTICE T.S.SIVAGNANAM WMP Nos.2113 & 2114 of 2017 IN WP.2142 & 2143/2017 SHRI.R.SRINIVASAN, [PETITIONER IN BOTH THE PETITIONS] Vs THE INCOME TAX OFFICER [RESPONDENT IN BOTH THE PETITIONS] NON-CORPORATE WARD 3(1) NO.63, RACE COURSE ROAD, COIMBATORE Petitions praying that in these circumstances stated therein and in the respective affidavits filed therewith the High Court will be pleased to i) To stay all further proceedings pursuant to the Assessment Order dated 09.12.2016 bearing PAN.CEFPS0550C for AY 2009-10 passed by the Respondent as against this petitioner in (WMP No.2113/2017 in IN WP.2142/2017) and;

ii) Stay all further proceedings pursuant to the Assessment Order dated 09.12.2016 bearing PAN.CEFPS0550C for AY 2012-13 passed by the Respondent as against this petitioner in (WMP No.2114/2017 in IN WP.2143/2017) respectively.

Order : These petitions coming on for orders upon perusing the petitions and the respective affidavits filed in support thereof and upon hearing the arguments of M/S.P.J.RISHIKESH, Advocate for the petitioner in both the petitions and of M/S.A.P.SRINIVAS, Standing Counsel for the Respondent in both the petitions the court made the following order:- Mr.A.P.Srinivas, learned standing counsel for the respondent seeks four weeks time for filing counter. Considering the fact that the respondent has been repeatedly taken adjournment for filing counter and till date the counter affidavit having not been filed and the interim
