O R D E R

This writ petition has been filed challenging the appointment of the third respondent as Noon Meal Organiser. 2.

The petitioner applied for the post of Noon Meal Organiser and Noon Meal Helper. The eligibility/qualification for appointment to the post of Noon Meal Organiser as per Government order vide G.O. Ms. No. 78 Social Welfare and Noon Meals Department dated 30.06.2008 read with Proceedings in Na. Ka. No. 19131/2008/NMP2 dated 09.09.2008 is as follows:

A. Only females are eligible for the said post; B. First preferance should be given to poor widows, deserted womens and physically handicapped person; 2/6

C. Age should be above 25 and below 40;

D. The applicant must be a resident of the village in which the Noon Meal Centre is situated, if not available within the Panchayat limits then the person in nearby the villages situated within 10 kms from the Non Meal Centre can be considered.

The petitioner was called upon for interview. However, she was not appointed and the third respondent was appointed to the said post. 3.

On perusal of the counter filed by the first respondent, revealed that the third respondent was selected on the basis of the interview beside her higher qualification than the petitioner. Therefore, the third respondent was recommended for appointment and accordingly, the third respondent was appointed to the post of Noon Meal Organiser and posted in the Panchayat Union Elementary School. 4.

Therefore, this Court do not find any infirmity or illegality in the order passed by the first respondent. As such, this writ petition is devoid of merits and liable to be dismissed.

Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to 3/6

costs.
