ORDER

The revision petitioner / plaintiff has filed this Civil Revision Petition to set aside the Fair and Final Order dated 08.08.2025 passed in I.A.No.16 of 2025

in O.S.No.854/2013 on the file of the II Additional District Munsif Court, Salem.

2. The plaintiff filed an application before the trial Court to implead the Government officials, namely respondents 10 to 12. The said application was dismissed by the learned trial Judge on the ground that they are unnecessary parties. The trial Court held that the dispute between the plaintiff and the first defendant is only based on the alleged unregistered sale agreement and, therefore, those officials are in no way connected with the alleged agreement. Hence, the learned trial Judge dismissed the I.A.No.16 of 2025 in O.S.No.854/2013. Aggrieved by the same, the present revision has been filed by the plaintiff.

3. The learned counsel for the respondents submitted that, even assuming that there is an alleged sale agreement, the plaintiff has not filed any suit seeking specific performance. On the other hand, he has filed the suit only for permanent injunction and now seeks to implead Government officials, namely the Sub-Registrar, District Registrar and District Collector, Salem as respondents 10 to 12, who are in no way connected with the alleged sale agreement. Therefore, learned the trial Judge has rightly dismissed the application.

Considering the submissions made on both sides, the facts reveal that the plaintiff claims that there is a sale agreement between himself and defendants 1 and 2 based on an alleged unregistered sale agreement dated 01.01.2012. However, the plaintiff has filed the suit only for permanent injunction restraining interference and also for mandatory injunction to fix the boundaries. During the pendency of the suit, he came forward with an application to implead the Sub-Registrar, Registrar and Collector as respondents 10 to 12.

5. Admittedly, they are in no way connected with the alleged sale agreement. It is also stated that the third defendant had already purchased a portion of the property in the year 2012 and service stones were also planted. Even otherwise, those officials are not connected with the alleged agreement. Therefore, impleading those officials is unnecessary. In that view of the matter, the learned trial Judge has rightly dismissed the said application, as also rightly pointed out by the learned Government Advocate.

6. Accordingly, the Civil Revision petition is dismissed as devoid of merits. Consequently, connected miscellaneous petition is closed. No Costs. 09-03-2026 Index:Yes/No
