Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to pay the amount of Rs.18,500/- payable towards Retirement Benefits Scheme Recovery (RBSR) Amount to the petitioners along with 12% interest per annum from the date of retirement within the time frame fixed by this Hon'ble Court.

ORDER

This Writ Petition has been filed in the nature of a mandamus seeking a direction against the respondents to pay a sum of Rs.18,500/- which is payable towards Retirement Benefit Scheme Recovery to the petitioners. The petitioners also seek interest at the rate of 12% per annum from the date of retirement till the date of disbursement.

In the affidavit filed in support of this Writ Petition, it is contended that the petitioners had retired from the respondents Corporation and during the period of service, they had paid amounts under the Retirement Benefit Scheme. The said amount, which had been deducted from the salary, had not been disbursed to the petitioners on and from the date of retirement.

3. A Mandamus is issued directing the respondents to examine the Service Register of the three petitioners and also examine whether the retirement benefits had already been paid and further examine whether the Retirement Benefit Scheme Recovery amount which had been 2/4

deducted from the salary had been paid to the petitioners and if not, pay the same within a period of six weeks from the date of receipt of a copy of this order. If the petitioners are eligible to be paid the said amount, then, for the belated payment, the respondents would also liable to pay interest at the rate of 6% per annum from the date of retirement till the date of actual disbursement.
