It is the 4th Anticipatory Bail application and the earlier application has been dismissed by this Court with a well reasoned order.
2. Today, the respondent police has filed a counter, wherein, in paragraph No.2, it is stated as follows:
"2.It is submitted that the brief facts of the case is as follows: The case of the prosecution is that the complainant Tr.A.S.Balasubrmanian has stated that he is an Advocate, High Court, Madras. The petitioner/accused was running a company, name and style Annamalaiyar Enterprises, SIDCO Nagar, Chennai-49. While so, one Jayaprakash had approached the petitioner/accused to change his sister's son 'Shyam Sunder' from 'Shyam Sundar' regarding that he asked to the petitioner to organize the 'Deed Poll Sworn Affidavit' and the same was prepared by the petitioner/accused with the forged signature of the complainant and seal. On 20.08.2014 at about 8.00p.m. the said Jayaprakash had approached the complainant to rectify some errors in the said 'Deed Poll Sworn Affidavit'. It reveals that the petitioner/accused has impersonated as a lawyer [complainant] and has given notary certificates for obtaining passports in the name of the defacto complainant. Hence, the complainant lodged a complaint before
the respondent police station, based on that a case was registered in V-1, Villivakkam Police Station crime No.1692 of 2014 under Sections 419, 465, 468, 472, 474 IPC by Tr.Balasubramaniam, the then Inspector of Police on 05.10.2014 at 09.30 hours and he took up investigation."
3. It is seen that this petitioner is not an Advocate, but, he has been issuing notary certificates, left, right and center to everyone. Taking into consideration, the serious nature of the allegation against the petitioner and further, there is no change in fact situation after the earlier application was dismissed by this Court, there are no grounds for granting the relief as prayed for.
