This petition is filed to condone the delay of 232 days in filing the above Civil Miscellaneous Appeal before this Court against the order dated 09.03.2022 made in MCOP.No.35 of 2016, on the file of the Motor Accident Claims Tribunal / Subordinate Judge Court, Sankari.

2.Since first respondent remained ex parte before the Tribunal, notice to the first respondent is dispensed with. 3.M/s.N.B.Sureka, learned counsel entered appearance for the second respondent.

4.Heard. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

5.It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, he would not be entitled to any interest for 232 days.

6.The Registry is directed to number the above C.M.A.SR.No.24540 of 2023, if the papers are otherwise in order.
