Respondents Prayer : Writ Petition filed Under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to give the petitioner fifth review with effect from 01.08.2012 with arrears and all other consequential benefits for the period from 01.08.2012 to 31.03.2012 and also to revise his terminal benefits based on the pay actually payable to him based on the fifth review as on the date of his retirement with arrears and all other consequential benefits, together with interest at the rate of 12 % per annum, award costs.

ORDER
The learned counsel for the petitioner made a submission that on account of the strike by the transport corporation employees, the review benefits were denied. However, during the subsequent 12 (3) Settlement dated 24.08.2002, it was agreed between the management and the Labour union to settle the review benefits which were denied to the employees who were on strike. Thus, the respondents are directed to consider the case of the writ petitioner in term of 12 (3) Settlement already signed between the parties.
