Mrs. K.Bhargavi ...Defendant Plaint under Order IV Rule 1 of the OS Rules and read with under Order VII Rule 1 of the CPC to direct the defendant to pay a sum of Rs.14,66,035/- towards arrears of rent and damages for the damage caused to the suit property and value of the amenities removed by the defendant from the premises and a sum of rs.15,00,000/- towards compensation for mental agony suffered by the plaintiff due to the false and defamatory allegation made by the defendant in all totaling a sum of Rs.29,66,035/- together with interest at the rate of 24% p.a. from the date of plaint till the date of realisation and to direct the defendant to pay the cost of the suit. JUDGMENT

The learned counsel appearing for the plaintiff submits that the parties have settled the matter out of the Court. Therefore, he submits that the suit may be dismissed as settled out of Court. He has also made and endorsement to that effect. 2.Considering the submissions made by the learned counsel for the plaintiff and in view of the endorsement made, this Suit is dismissed as settled out of Court. Accordingly the Application No. 5987 of 2015 is closed. No costs.

3. The Registry is directed to refund appropriate Court fee to the plaintiff as permissible under law.
