Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition order dated 08.02.2017 (i.e.) to appear and sign on every 1st day of the month as passed in Crl.M.P.NO.405 of 2017 in Crl.R.C.No.38 of 2017 pending disposal of the Revision and pass such further or other orders. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.THANJAN, Advocate for the petitioner and of Mr.R.SEKAR, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- This Court by an order dated 08.02.2017, while granting the order to suspend the sentence imposed against the petitioners, had imposed a condition that the petitioners shall appear before the trial Court on the first working day of every month at 10.30 a.m., pending revision case. In order to relax the condition imposed against the petitioners, the present petition has been filed.
2. Mr.R.Thanjan, learned counsel appearing for the petitioners states that from the date of the said order i.e. from February 2017 onwards, the petitioners have been complying with the said condition imposed by this Court. The learned Government Advocate (Criminal Side) appearing for the respondent would also state that the petitioners have been complying with the said condition till date without fail.
3. In view of the said position, since the petitioners have been complying with the condition imposed by this Court, continuously, without any deviation, this Court is inclined to
entertain this petition at this juncture to relax the condition.
4. Accordingly, the condition that the petitioners shall appear before the trial Court on the first working day of every month at 10.30 a.m. as imposed by this Court by order dated 08.02.2017 is hereby relaxed.
