ORDER : The Court Made the following order :- The petitioner was arrayed as an accused in a case for the offence under Section 174 of Cr.P.C. and subsequently altered to 306 of I.P.C. where one Neelakandan committed suicide leaving behind a suicide note implicating this petitioner as cause for his death.

2. The learned Additional Public Prosecutor appearing for the respondent states that the suicidal note with admitted handwriting of the deceased person has been sent for the handwriting expert and the same is awaited.

3. The learned counsel for the petitioner would submit that in the observation mahazar, there is no whisper about the suicidal note and this suicidal note had cropped up so as to arrest the petitioner herein. The contention of the petitioner shall be considered only after the receipt of the handwriting expert opinion. As of now, the contention of the suicidal note clearly indicates that the petitioner herein borrowed a sum of Rs.3 lakhs from the deceased and refused to return it and he also threatened the deceased with dire consequences with the help of rowdy elements. Hence this Criminal Original Petition for bail is dismissed for the present.
