IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 12.12.2020

CORAM:

THE HONOURABLE MR. JUSTICE N.ANAND VENKATESH W.P.No.18042 of 2020 T.Alimabeham

...Petitioner

Vs.

The Thasildar O/o.The Thasildar Puzhal, Chennai 600066.

...Respondent

This Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to consider and dispose of the representation dated 13.02.2020.

For Petitioner :

Mr.R.Arunkumar

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondent to consider and dispose of the representation made by the petitioner on 13.02.2020, wherein the petitioner is seeking for taking possession of the subject property with the help of the respondent.

2.

The case of the petitioner is that the subject property originally belonged to her father and she is entitled for a share in the said property. The further case of the petitioner is that she sold a portion of the property and retained nearly 81⁄4 cents. The grievance of the petitioner is that some encroachers have taken possession of the property and the petitioner wants to identify her property and therefore, she has made a request to the respondent through a representation dated 13.02.2020 to find out who has occupied the property and who has put up construction in the property.

3.

In the considered view of this Court, the petitioner, instead of approaching a competent civil court and filing a suit for possession, is attempting to do it through the revenue authorities and the respondent cannot act upon such a representation made by the petitioner. It is not for the https://hcservices.ecourts.gov.in/hcservices/

respondent to go and find who has encroached upon the property and put up the construction. No useful purpose will be served in directing the respondent to consider the representation made by the petitioner and this Court is not inclined to entertain this Writ Petition.

5.

In the result, this Writ Petition is dismissed. No costs.
