Petitions filed under Sections 10 and 12 of the Contempt of Courts Act, 70/71 to punish the respondents for having committed contempt of Court for disobeying the order dated 19.06.2015 made in W.P.No.17566 of 2015. ORDER
(Order of the Court was made by The Hon'ble The Chief Justice) The Chief Secretary has filed an affidavit on account of non-compliance of our order dated 19.06.2015.
2. The matter pertains to the land donated by Thiru Subramaniya Siva to fulfil his dream of making temple for ''Bharatha Matha''. Despite repeated representations, there had been no response from the authorities. In fact, the say of the petitioner was that either the Government may construct the temple or the residents of the area are willing to contribute for such construction. We asked the matter to be dealt with within a period of two months from the date of communication of the order, which time period is long past.
3. The affidavit now filed reveals information was sought from local authorities and three months more time is required, as it involves a policy decision. Learned Advocate General also expresses some apprehension that this should not give rise to any divisive agenda. We are of view that there can be no divisive agenda in respect of construction of a temple in the name of ''Bharatha Matha'' as it is not obeisance to any deity - it has no religious overtures. If the Government is short of money, the residents are even willing to contribute for construction of the temple!
4. However, in view of the prayer made, we grant time till 30th November, 2015 to take appropriate decision in the matter by the authorities concerned in compliance of our order dated 19.06.2015.
