The petitioner, who was arrested and remanded to judicial custody on 29.01.2023 for the offences punishable under Sections 336, 342, 392, 397, 452 and 506(ii) of IPC in Crime No.46 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused entered into the clinic of the defacto complainant, caught hold him, put the scissors on his neck, taken away the money from table drawer, his cellphone, car key and CCTV camera and threatened him with dire consequences and fled away. Hence the complaint. 3.Learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has nothing to do with the alleged offence and he is ready to abide by any stringent condition that may be imposed by this Court. He also submitted that the petitioner is in

judicial custody from 29.01.2023 and hence, he prayed to grant bail to the petitioner.

4.Learned Government Advocate (Crl.Side) for the respondent submitted that the petitioner along with other accused entered into the clinic of the defacto complainant, caught hold him, put the scissors on his neck, taken away the money from table drawer, his cellphone, car key and CCTV camera and threatened him. He further submitted that the investigation is not yet completed and if the petitioner is released on bail at this stage, he would tamper the witness and hamper the investigation. Hence, he vehemently opposed to grant bail to the petitioner. 5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the materials available on record.

6.Considering the facts and circumstances of the case and the submissions made by both counsel and also considering the gravity of the

offence committed by the petitioner and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 01.03.2023 vkr
