The petitioners/A1 to A5 in Crime No.171 of 2024 registered by the respondent police for the offences punishable under Section 408 of IPC seek anticipatory bail.

2. The defacto complainant is the Assistant Postal Supervisor in Railway Main Service. It was found that there was misappropriation of more than Rs.7,00,000/- in booking Amazon Speed articles between 2017 and 2018 for a period of just seven months. This would effectively mean that every month the accused had benefited to an additional unlawful income of Rs.1,00,000/-

3. The learned counsel for the petitioners pointed out the proceeding by which there was recovery of the amount from the accused persons/petitioners herein. One of the grievances expressed is that as 1/3

many as 25 persons had benefited by this method of misappropriation, but FIR had been lodged only against the petitioners. It would only indicate that the petitioners had definitely misappropriated amounts which should have been accounted to the Government Account.

4. Taking the fact that the recovery would only strengthen the case of the prosecution, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. Vv 28.02.2024 2/3
