ORDER
This writ petition has been filed to forebear the respondents from conducting the survey of the property morefully described in the prayer to this writ petition based on the petitioner's representation dated 25.12.2025.
2. The seventh respondent had already approached this Court by filing a writ petition in W.P. No.28301 of 2025, seeking for survey and demarcation of the boundaries of the very same property, which is the subject matter of this writ petition. By an order dated 05.08.2025 passed in W.P. No.28301 of 2025, a direction was issued to the respondents to survey and demarcate the boundaries
after hearing the objections of all the necessary parties, which includes the adjacent land owners. The petitioner is an adjacent land owner of the seventh respondent.
3. The apprehension of the petitioner in this writ petition is that without hearing the petitioner's objections, the official respondents are attempting to survey and demarcate the boundaries. The apprehension of the petitioner is uncalled for, since the earlier order dated 05.08.2025 passed by this Court in W.P. No.28301 of 2025 has made it clear that the objections of the neighbouring land owners will have to be heard by the official respondents and only thereafter, survey and demarcation of the boundaries will have to be done. Instead of raising all objections before the official respondents and before a decision can be taken, the petitioner has filed this writ petition, which is premature.
4. Necessarily, the official respondents will have to consider the objections raised by the petitioner as stipulated in the earlier order passed in the writ petition filed by the seventh respondent and only thereafter, proceed to survey and demarcate the boundaries. It is made clear that the petitioner shall necessarily cooperate with the official respondents pursuant to the order dated 05.08.2025 passed in the writ petition filed by the seventh respondent in W.P. No.28301 of 2025.
5. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
