[Respondent] Petition filed under Section 482 of the Criminal Procedure Code, to set aside the order passed by the learned XI Metropolitan Magistrate, Saidapet, Chennai in Crl.M.P.No.2242 of 2016 dated 26.08.2016 and to modify the condition imposed by the learned XI Metropolitan Magistrate, Saidapet in Crl.M.P.No.2223 of 2015 dated 26.06.2015.

O R D E R

The petitioner filed a bail application before the learned XI Metropolitan Magistrate, Saidapet, Chennai and bail was granted on condition that the petitioner shall execute a bond for a sum of Rs.50,00,000/- with two sureties each for the like sum to the satisfaction of the Magistrate and on further condition to appear before the respondent police every day, until further orders. Subsequently, the petitioner filed a petition before the Magistrate to relax the said condition and the condition was modified to the effect that the petitioner https://hcservices.ecourts.gov.in/hcservices/

shall appear before the respondent once in a week and thereafter, again it was modified to appear once in a month, on filing another petition, and the petitioner is complying with the condition from 01.07.2015 strictly without fail. Now the petitioner has come up with this Criminal Original Petition to modify the said condition.

2.The learned Additional Public Prosecutor submits that the petitioner is complying with the said condition and he is appearing before the respondent police regularly for the past 1 1⁄2 years.

3.In view of the above submission made by the learned Additional Public Prosecutor, and the facts and circumstances of the case, the condition imposed on the petitioner to appear once in a month on the first working day of every month is modified to the effect, that the petitioner shall appear before the respondent police, as and when required for interrogation. 4.The Criminal Original Petition is ordered accordingly.
