This Criminal Miscellaneous Petition has been filed to condone the delay of 984 days in filing the criminal revision case. 2.The petitioner was convicted by the learned Chief Judicial Magistrate, Cuddalore (Trial Court) in C.C.No.38 of 2014 and sentenced to undergo three months Simple Imprisonment and to pay a fine of Rs.1,000/- in default to undergo two months Simple Imprisonment for offence under Section 304(A) of IPC and for offence under Section 338 of IPC (2 counts), the petitioner to pay a fine of Rs.1,000/- on each count, in default to undergo Simple Imprisonment for two months for each count. Challenging the conviction and sentence of the trial Court, the petitioner preferred an appeal before the I Additional District and Sessions Judge, Cuddalore in Crl.A.No.71 of 2015 (lower appellate Court). The lower appellate Court vide judgment, dated 29.03.2019 partly-allowed the appeal modifying the sentence. Challenging the same, the present Criminal Revision Case and the condone delay petition for 984 days.

vv2 3.Today, it is represented by the learned counsel for the petitioner that the petitioner surrendered before the trial Court on 07.02.2024. 4.Mr.S.Raja Kumar, learned Additional Public Prosecutor takes notice for the respondent Police and he has got no objection in allowing this petition. 5.Being satisfied with the reasons stated in the affidavit, this Court condones the delay of 984 days in filing this criminal revision case. Registry is directed to number the revision if it is otherwise in order. Remove the name of Public Prosecutor, Puducherry from the cause list.
