Transfer Civil Miscellaneous Petition filed under Section 24 of CPC praying to withdraw HMOP.No.97 of 2018 on the file of the Principal Sub Court at Tindivanam and to transfer the same to the Family Court at Chennai.

ORDER

The petitioner is the wife of the respondent. The respondent/husband has filed a petition in HMOP.No.97 of 2018 against the petitioner/wife before the Sub Court, Tindivanam for divorce.

2.According to the petitioner/wife, she is now residing at Chennai at her parental home and she has to travel a long distance from Chennai to Tindivanam along with her son, to attend the hearings which causes physical and mental hardship to her. Therefore, she seeks for withdrawal of HMOP.No.97 of 2018 on the file of the Principal Sub Court, Tindivanam and to transfer the same to the Family Court, Chennai.

3. Heard the learned counsel appearing for petitioner and learned counsel appearing for the respondent. Learned counsel for respondent has no serious objection to transfer HMOP.No.97 of 2018 on the file of the Principal Sub Court, Tindivanam to the Family Court, Chennai.

4. In view of no objection expressed by the learned counsel https://hcservices.ecourts.gov.in/hcservices/

for respondent, HMOP.No.97 of 2018 pending on the file of the Principal Sub Court, Tindivanam is withdrawn and transferred to the Family Court, Chennai. No costs.

5. The Principal Sub Court, Tindivanam is directed to transfer the case HMOP.No.97 of 2018 to Family Court, Chennai. The learned Family Judge, Chennai is directed to re-number the petition, issue notice to both the parties and dispose of the same as expeditiously as possible. Consequently, the connected C.M.P.No.5267 of 2019 is closed.
